doctrine. A few months later (25 September 1833) a royal decree was issued, according to which the most of the Holy Monasteries were dissolved and their possessions were confiscated by the State. The conclusions of this dissertation are the following : a) the royal decree of 25th September 1833 is invalid reasoning to omission of publication in the Official Gazette, b) the same decree and the legislation based on its legal consequences were suppressed after the enforcement of Hellenic Constitution of the year 1844 (Articles 12, 103), according to which no one may be deprived of his property unless in the public interest and according to the procedure laid down by law and in every case subject to full prior compensation; the precedent opposite provisions are no more in valid, c) the above mentioned royal decree and the relative laws cannot be invocated due to the force of Article 1 of Protocol No 1 (Art. 1 P-P) of ECHR, d) the article 39 3 s. 2 of Law No 590/1977 does not restore for the first time, but proceeds in recognition of the Greek Orthodox Archdioceses as owners of fortune of the dissolved Monasteries, e) the legislation concerning the protection of antiquities (Law No 3028/2002) does not hinder the right of property of the Archdioceses in all religious monuments of dissolved Monasteries that are considered ancient monuments.
