    PRELIMINARY INVESTIGATION AND CONSTITUTION

    During the preliminary investigation, some human rights are

    restricted and its necessary for the state to ensure them. The Greek

    Constitution protects the defendant with the articles 2, 5, 6, 7, 9, 9A, 19

    and 20 which refer to the respect of the human value, to the personal

    freedom and safety, to the forbiddance of any torture, to the protection of

    the sanctuary ,the protection of the personal data and the secrecy of letters

    and all other forms of free correspondence or communication and finally

    ,the legal protection by the courts and the right to a prior hearing.

    Moreover, the human rights are ensured with international and

    European laws such as the European Agreement of Human Rights, the

    Map of Fundamental Rights of European Union, in the 6th chapter which

    refers to the justice and finally, the Universal Declaration of human rights.
