CIVIL PROCEDURE*

What is a civil case?

A civil case, commencing with the submission of a plaint to theCourt, whether such plaint is made orally or in writing, is the casewhere there are unsettled disputes, arguments, or accusations withregard to personal rights in general, for instance, a plaint requestingthe borrower and the surety to perform their obligations under the loanand the suretyship agreement, and a claim for eviction of a tenant fromthe leased premise. The purpose thereof is to enforce the defendant toperform his or her obligation, to act or to restrain from certain actionfor the benefit of the plaintiff, not to impose physical punishment onthe defendant, for instance, imprisonment or detention, or to imposemonetary sanction on the defendantûs property, for instance, fine orforfeiture of property.

Besides the aforementioned disputes, arguments or accusations,civil cases also include the case where any third person is legallyrequired to file an application with the Court for acknowledgementand protection of his or her rights, for instance, an application forthe Courtûs order with respect to the ownership of a land with titledeed, acquired through peaceful and open possession of such property,and with the intention to be its owner, for an uninterrupted period of tenyears, or a request for administering the estate of the deceased.

Question: What are the rights a person shall have in order to bring

a civil case to the Court?

Answer: Any person who intends to bring a civil case to the Courtshall bear two grounds prescribed by the law as follows:

1. the existence of disputes or accusations with regard to therights or duties of a person under the civil law; or

2. the existence of causes and necessities to exercise the rights,as acknowledged and protected by law, through the Court.

In the first instance; the existence of disputes or accusationswith regard to the rights or duties of a person under the civil law.This is the case where an act of a person causes disturbance, annoyance,damage, or infringement of legal rights of others which are the rights inproperty, money, life, body, family, honor, fame, or any other rightsin accordance with any lawful agreement and as specified by the law.

In the second instance; the existence of causes and necessitiesto exercise the rights, as acknowledged and protected by law, throughthe Court. This is the case where it is legally required that certainaction can be undertaken, or some rights can be exercised, only uponthe Courtûs approval or acknowledgement, for instance, a requestfor appointing an administrator of the estate, a request for the Courtûsapproval for entering into a juristic act on behalf of a minor, arequest for the Courtûs order in determining a person as incapacitated,quasiincompetent, disappeared, or a request for the Courtûs order onan acquisition of a land via adverse title, etc. In such cases, a claimantis not required to bring an action against anyone as a defendant.The claimant may file a motion to the Court stating his or her causes,necessities and requirements; thereafter, the Court will fix the date forhearing the motion. This kind of case is called a çnon-contentious caseé.

2. The amount of money in dispute; whether such caseis within the competence of the Provincial Court or the Kwaeng Court.1

The Provincial Court is competent to try and adjudicate thefollowing cases:

The Provincial Court is competent, generally, to try andadjudicate every kind of case except those cases that are specificallyprescribed by the law to be subject to the competency of any otherCourt, for instance, the Court with specialties on a certain kind of case.The Provincial Court is situated in every province or in some districts.However, only civil cases of the following nature will be in thecompetence of the Provincial Court:1 According to Section 17 of the Law for the Organization of the Courts of Justice,Kwaeng Courts shall have power to try and adjudicate cases and to examine or issue anyorder for which a single judge is competent. In sum, those cases within the jurisdiction ofthe Courts mainly comprise (1) civil cases in which the value of property in dispute or theamount of claims does not exceed 300,000 baht and (2) criminal cases of which amaximum punishment provided by law does not exceed three years imprisonment or 60,000baht fine or both imprisonment and fine, provided that no punishment exceeding six monthsimprisonment or 10,000 baht fine or both imprisonment and fine, both or any of whichexceeds the mentioned rate, may be imposed.

Except for the Courts that are competent to try andadjudicate cases in accordance with the Constitution, for instance, theAdministrative Court or the Constitutional Court, the plaint institutinga case shall only be filed with the Court of First Instance, unlessexpressly stipulated otherwise by the law, for example, a plaintclaiming unusual wealth or unusual increase of property of theperson holding political position or the National Anti-CorruptionCommissioner. This kind of case shall be initiated with and becomefinal at the Supreme Court Criminal Division for Persons Holding ofPolitical Positions.

Answer: In accordance with the Act Authorizing the Applicationof the Criminal Procedure of the Kwaeng Court with the ProvincialCourt, in any province that has only the Provincial Court and ProvincialJuvenile and Family Court (or Provincial Court, Juvenile and FamilyDivision), the plaintiff shall file a case that is within the competenceof the Kwaeng Court with the Provincial Court.6

Answer: The expenses incurred are as follows:1. Court fees: court fees are the fees charged by the Court

upon entry of plaints or motions filed or applied by the person whoserights and duties under the civil law are in dispute. For instance, Mr. Afiles a plaint with the Court, he then will be charged with the court feesas specified by the law. The court fees can be categorized as follows:

Cases with computable monetary value claimThese are the cases where the relief sought is to acquire

a sum of money or a property which is computable in terms of money,and yet does not belong to him or her, from another person. The claimedamount of money or value of property, such as houses, lands or cars,shall be deemed as the amount of money in dispute, for instance,claims for performance of obligations under the loan, mortgage,suretyship agreement, or an agreement to sell or to buy real estate, etc.

In cases with computable monetary value claim, court feesfor the amount not exceeding fifty million baht shall be the rate of2 baht per hundred baht of the amount of money in dispute but shallnot exceed two hundred thousand baht. For the amount exceedingfifty million baht, the court fees shall be charged at the rate of 0.1 bahtper hundred baht of the claimed amount.

Cases with non-monetary claimThese are cases where the relief sought is to cease

grievances or damage that is not computable in terms of money, forinstance, a request for enforcing the defendant to take some action orrestrain from doing certain action for the benefit of the plaintiff withoutany request or claim for a sum of money or certain properties.7

In the cases with non-monetary claim, the plaintiff will becharged at the rate of 200 baht per case. The charge for the case wherethe relief applied for is partly computable in terms of money and ispartly not computable shall be at the same rate charged for cases withcomputable monetary value claim but not less than 200 baht.8

Court fees charged on the plaint regarding the recognitionand enforcement of domestic arbitral awards shall be at the rate of0.5 baht per hundred baht of the claimed amount which does notexceed fifty million baht, but this charge shall not exceed fifty thousandbaht. In addition, the amount exceeding fifty million baht shall becharged at the rate of 0.1 baht per hundred baht of the claimed amount.

The charges for the plaint requesting the enforcement orforeclosure of mortgage shall be at the rate of 1 baht per one hundredbaht of the claimed amount, which does not exceed one hundredthousand baht and the amount exceeding fifty million baht shall becharged at the rate of 0.1 baht per hundred baht of the claimed amount.However, if the defendantûs answer is against the case, the court feesshall be charged at the same rate charged for cases with computablemonetary value claim. This rate only applies to those plaints whichthe claim relates solely to the obligation under the mortgage, which isan accessory obligation itself, but does not relate to the principalobligation. If the claims include the principal obligation, the court feeswill be charged at the same rate charged for cases with computablemonetary value claim,9 otherwise it will be considered as an evasion ofcourt fees.

If the defendant answers that he or she did not receive anynotice, this case shall be deemed as the defendant having made his orher argument and, thus, the court fees shall be at the same rate ascharged for cases with computable monetary value claim.

Appeal or Dika appeal** against orders made in accordancewith Section 227 or 228 (2) (3) of the Civil Procedure Code shall besubject to 200 baht court fees per case but appeal or Dika appeal inaccordance with Section 228 (1) shall not be charged.

Court fees for future claim: the plaintiff is subject toadditional 100 baht court fees for future claim which is the claim inrelation to rent, interest, and damages.10

Besides those cases requesting a payment of interest, rentor damages upon which the Court is authorized to make a judgmentor issue an order under Section 142 of the Civil Procedure Code,the plaintiff is subject to additional 100 baht court fees for this partof claim.11

Preferential claims for repayment of debts secured bymortgage filed by a preferential creditor shall be subject to the courtfees at the rate of 1 baht per one hundred baht of the amount of claim.In such case, if the plaintiff opposes such claim, the secured creditorshall be subject to court fees at the same rate as charged for cases withcomputable monetary value claim. However, if such secured creditoris a judgment creditor, the court fees shall not be charged.

Charges for the preferential claims for repayment of debtsshall be in accordance with the amount of money in dispute, forexample, tax liabities.

A request for the release of the property seized by theexecuting officer claiming that the defendant or the judgment debtoris not the owner of such property, the claimant shall be subject tothe court fees in accordance with the value of property in disputeso requested. The amount of claim in this case shall be computable inseparation from the original case.

Additional court fees

Normally, the court fees will be calculated as of the date offiling the plaint. If there is any amendment in furtherance thereto,or any other causes that result in the increased amount of claim, theplaintiff shall be subject to additional court fees charged on the amountincreased.

2. Other court fees in civil cases

A request for an order directing the evidence to be takenat once under Section 101 before filing a plaint shall be at the rate of100 baht.

3. Other expenses

In civil procedure, the parties may be subject to otherexpenses, for example, cost of delivering a summons, allowance forsurvey and mapping, witness fees and traveling expenses, cost ofexamining documents by experts.

Question: Which case will the plaintiff or the defendant be exempted

from court fees?

Answer: A plaintiff or a defendant who is unable to pay court feesmay file an application by motion for exemption of court fees whichcan be filed to every level of Courts. In accordance with the lastparagraph of Section 149 of the Civil and Commercial Code, suchmotion is exempted from court fees.

The applicant shall file an application by motion with theCourt together with his or her plaint, petition of appeal, or answer.

If the Court believes the applicant does not have sufficientassets to pay court fees or, when considering his or her circumstances,the applicant shall have excessive trouble if an application forexempting of the court fees is dismissed, the Court may give an orderexempting in whole or only part of court fees. In the case where theapplicant is the plaintiff or appellant, the reasonable entry of a plaint orpetition of appeal shall be taken into consideration of the Court beforegiving an order as well.

Question: What are petty cases?

Answer: Petty cases are the following:1. the cases where the sum of the requested money or the

amount of money in dispute does not exceed 300,000 baht or does notexceed the sum as prescribed by the Royal Decree;

2. the cases for the eviction of any person from a premiseor a house or land having a rent, or can be leased at the time of filingthe plaint not exceeding 30,000 baht or not exceeding the sum asprescribed by the Royal Decree. A petty case can be a case withcomputable monetary value claims or a case with non-monetary claims.

Question: How to submit a petty case to the Court and what are

the procedures for proceeding a petty case?

Answer: A petty case is subject to the same court fees as ordinarycivil cases but the total amount of such fees shall not exceed 1,000 baht.A petty case is also subject to other expenses as ordinary civil cases.

The plaintiff may file a petty case to the Court either byfiling a plaint in writing or by appearing in person to state his or herclaims verbally before the Court.

Upon acceptance of such case, the Court shall fix the datefor hearing as soon as possible and shall issue a summons setting forththe issues of the case. Such summons shall have a statement requiringthe defendant to appear before the Court on such date for reconciliation,to make an answer and to take evidence, and the Court shall orderthe plaintiff to appear on such date.

If the defendant does not make an answer, the Court may, atits discretion, proceed with the trial of the case whereby the defendantis deemed to be in default of answer.

Unless the Court grants permission for an adjournment ofthe case, if the plaintiff does not appear before the Court on the datefixed for a hearing, it shall be deemed to be an expression of his or herintention not to proceed with the case. The Court shall issue an order tostrike the case out of the case list.

On the date fixed for a hearing, the Court shall, upon theplaintiffûs and the defendantûs presence, reconcile the parties at its firstoccasion.

In a petty case, the Court may adjourn the case only uponthe cause of necessity and each adjournment shall not exceed 7 days.

Question: How to submit a Non-complicated Case to the Court and

what are the procedures for proceeding such cases?

Answer: The Non-complicated Case is subject to the same court feesas an ordinary civil case, without limitations on the amount of claim.If the Court is of opinion that the case is not complicated, the Courtmay issue an order to proceed such case as a petty case and shall issuea summons to the defendant stating the amount of money claimed,the grounds thereof, and requiring the defendant to appear beforethe Court and to make an answer on the fixed date.

When the defendant appears before the Court, the Courtshall record the statements made by the defendant in the memorandumof proceeding. If the Court, upon examining the defendantûs statementand answer, is of opinion that the defendant has no grounds to defend,the Court shall try and adjudicate the case promptly; but if it appearsto the Court that the defendant has a reasonable defense, the Courtshall proceed with the trial without delay and hear the evidence ofboth parties before giving the judgment.
