I. TITLE INFORMATION TITLE STATE/NATION - Yes - Titles are issued to all motor vehicles, commercial trailers, travel trailers, pop-up tent trailers, ATVs purchased after 7-18-06, special motorized machinery, boats and outboard motors in excess of 10 horsepower. NOT TITLED are snowmobiles, and off-road vehicles. See Mobile Homes below. The follow-ing trailers are not required to be titled: boat trailers, trailers used to haul personal items, and farm or utility trailers. (also see Section V.) TITLE APPLICATION - Title applications are submitted to the Cherokee Nation Tax Commission. Handwritten applications are accepted along with those submitted by mail. TITLE FEE - $6.00 DUPLICATE TITLE FEE - $6.00 REGISTRATION TAXES APPLICABLE TO TITLE - Tax is due at the time of issuance of Certificate of Title and is collected by the Cherokee Nation Tax Commission Motor Vehicle Division. Registration Tax must be col-lected upon all subsequent transfers of legal ownership. Registration Tax will be based upon the actual purchase price of a vehicle, excluding any trade in, provided that price must be within 20 % of the actual book value of the vehicle. New vehicles – 1.5% of actual purchase price. Used vehicles – 1.5% of actual purchase price. Registration tax is delinquent from and after the 30th day after legal ownership of possession is obtained. Tribal Citizens pay Registration Tax on vehicles purchased in another state. MOBILE HOMES – NEW – Registration Tax shall be 1.5% of the retail selling price. USED - .75% of the retail price. Ad Velorem tax is paid at the County Assessors Office where the mobile home is located. TITLE ONLY ISSUED - Title not issued without registration. FAST TITLE SERVICE - No - Normal processing time for walk-in applications, Title is mailed to the applicant within 10 business days. Mail-in applications take 2 to 4 weeks. ABSTRACT OR MEMORANDUM TITLE - (NON-NEGOTIABLE) - (TITLE HELD) - Certificate of Title issued but not delivered to the owner of an out-of-state vehicle that is subject to registration and cannot produce the Title because the out-of-state Title is being held by a lienholder. TITLE BRANDS – Yes – Add Lien, Release Lien, Classic, Damaged by Flood, Duplicate, Junk, Odom Discrep, Rebuilt, Recovered Theft, Repossession, Salvage. Brands are forwarded onto following Titles. Title brands from other states are carried forward onto subsequent Titles. ABANDONED VEHICLES (MECHANICS, ETC.) - All vehicles stored, parked, or left in a garage, park, or other storage facility must be reported to the Department of Public Safety after 30 days. To determine ownership of an abandoned vehicle and the existence of any lienholder, so that they may be notified of the sale for storage fees or mechanics lien, contact the Cherokee Nation Tax Commission Motor Vehicle Division if the vehicle has a Cherokee tag, For the State of Oklahoma or other states WRITE THE MOTOR VEHICLE DEPARTMENT OF THAT STATE AND IDENTIFY THE VEHICLE BY THEIR TAG NUMBER AND THE VEHICLE'S IDENTI-FICATION NUMBER to determine the owner and lienholder. Letters from out-of-state Motor Vehicle Depart-

ments, giving owner and lienholder information, must be attached to paperwork (teletype printouts are not accept-able). The Motor Vehicle Division needs a copy of the following documents: (1) Notice of Sale; (2) Proof of Post-ing and Mailing; and (3) Return of Sale. The following "Notices of Sale" are required: (1) 3 copies in public places; (2) Mail one copy by Certified Mail with "Return Receipt Requested" to: (a) party who brought vehicle in; (b) registered owner as shown in files of state vehicle is tagged; (c) all lienholders of record. Receipts from Certi-fied Mail must be surrendered with paper work. SALVAGE TITLE - Any insurance company that pays a total loss (60%) on a vehicle, any junk dealer, or any person dismantling a vehicle shall receive the Title on said vehicle. The Title shall be surrendered to a Tax Com-mission Agent with a proof of loss statement, which reflects the full description of the vehicle, date of loss and a request for the appropriate Title. A subsequent Title is issued reflecting the salvage designation and date of loss, which will remain on the Title for the life of the vehicle. NOTE: SALVAGE means TOTAL LOSS. REBUILT TITLE - At the time the vehicle is rebuilt receive a Rebuilt Title so future owners know it was a sal-vage vehicle that has been rebuilt. JUNK TITLE - Any vehicle that is incapable of operation or use on the highway, has no resale value except as a source of parts or scrap and has eighty percent (80%) loss of the fair market value may obtain a Junk Title for a fee of $6.00. All delinquent taxes due the state must be paid prior to the Junk Title being issued. Junk titled vehicles CANNOT be rebuilt. REBUILT VEHICLES - Documents required are a Motor Vehicle Rebuilt Vehicle Inspection Request (41-01), Authorization for Travel and Inspection (42-01), original receipts reflecting the type of repair and the original Sal-vage Title and notarized bill of sale. Tax Commission Agent will collect a $10.00 inspection fee. JUNKED VEHICLES - Any insurance company that pays a loss of 80% or more of the fair market value of a vehicle, or any junk dealer who received a vehicle to be junked. or any person permanently dismantling or junking a vehicle shall receive the Title, detach the license plate and return the Title to the Cherokee Nation Tax Commis-sion. RECONSTRUCTED VEHICLES (ASSEMBLED VEHICLES) – Complete an affidavit of assembly and own-ership, listing the source and serial number of major components. The original source documents are required to be surrendered to the Cherokee Nation Tax Commission with the affidavit of assembly and ownership for ap-proval. The “make” listed on the title for a motor vehicle will be: First two characters “AV” denoting an assem-bled vehicle. Characters three and four will be the year of the body (94). The fifth and sixth characters will be the original make of the body (CH for Chevy). Example: The make listed on the title would be “AV95CH.” The year of the vehicle will correspond with the year listed on the make. Assembled motorcycles are titled as: Year – the year of completion, and Make – ASVE. Assembled Travel Trailers are titled as Year – Nation assigned VIN – The first two characters will be alpha characters “CN” then followed with eight numerical characters. These are issued to assembled vehicles, motorcycles, and homemade or shop-built travel trailers. Cherokee Nation does not reassign the original vehicle identification number back to the vehicle. Assigned numbers are also issued to “theft recov-ered” vehicles that have the public VIN plate removed. KIT VEHICLES - To title and register, a Manufacturer's Statement of Origin will be issued for the front end sec-tion or glider kit, showing the new serial number and complete description of vehicles including the model year. An itemized invoice will be prepared listing the front end section or glider kit, all new parts, labor, and showing the suggested retail selling price of all new parts used excluding federal excise tax. The invoice will also have a statement of facts as to the rebuilding of the vehicle and will refer to the old vehicle from which "power train" components were used. Invoice will show the date completed. CLASSIC - Classic - 25 years registered. MOPEDS, MOTORCYCLES, and RECREATIONAL VEHICLES - Titled and registered annually utilizing standard motor vehicle procedure.

CHEROKEE NATION ASSIGNED VIN – The first two characters will be alpha characters “CN” then followed with eight numerical characters. These are issued to assembled vehicles, motorcycles, and homemade or shop-built travel trailers. Cherokee Nation does not reassign the original vehicle identification number back to the vehicle. Assigned numbers are also issued to “theft recovered” vehicles that have the public VIN plate removed. BOATS - The owner of every vessel or outboard motor in excess of 10 horsepower in this state shall possess a Certificate of Title as proof of ownership of such vessel or motor. An Application for a Certificate of Title, whether an original or duplicate, may be made to the Cherokee Nation Tax Commission. The title fee is $6.00. MOBILE HOMES - Initially titled and registered through the end of the calendar year utilizing standard motor vehicle procedures. Thereafter, placed on county ad valorem tax rolls. Transfer Title is issued upon change of own-ership with proof of current ad valorem taxes paid. Registration fees are based on purchase price (if buyer consid-ers the mobile home to be non-commercial). Titled through the Motor Vehicle Division. Vehicle Title is required. One Title is used regardless of how many units. Vehicle title fees apply. ATVs OFF-ROAD MOTORCYCLES - Titled and registered if purchased on or after 7/19/06. Annual fee is $6.00 and registration tax is assessed. LIMOUSINES I FOR-HIRE SEDANS - Limos may register as 1. non-commercial, 2. bus, or 3. taxi.

II. PROOF OF OWNERSHIP NEW VEHICLE - Manufacturer's Certificate of Origin properly assigned and notarized if required by the state in which the vehicle was sold. An accompanying invoice will show the actual sales price. Titles are issued centrally from Cherokee Nation Tax Commission, Tahlequah, Oklahoma.. OUT-OF-STATE VEHICLE - Vehicles require a Certificate of Title or Registration in the name of the applicant or Registration in the sellers’ name and notarized Bill of Sale to the applicant. USED VEHICLE - TITLE ISSUING JURISDICTION - Properly assigned Certificate of Title and current Reg-istration for Cherokee Nation vehicles; Title only from other states. USED VEHICLE - NON-TITLE ISSUING JURISDICTION - Out-of-state Registration and Bill of Sale on older models manufactured before their state became a title state. VEHICLE REGISTERED BY U.S. MILITARY AUTHORITY - NA. VEHICLE SOLD BY U.S. GOVERNMENT - Government Form No. 97. REPOSSESSED VEHICLE - When the ownership of any motor vehicle shall pass by operation of law, the per-son owning such vehicle may, upon furnishing satisfactory proof of ownership to the Commission, procure a Title to said motor vehicle, regardless of whether a Certificate of Title has ever been issued. A Repossession Affidavit is completed by the lienholder and submitted with the security agreement and lien releases to the Cherokee Nation Tax Commission, for approval. VEHICLE SOLD BY TRUSTEE IN BANKRUPTCY - Bill of Sale by Trustee. DEFECTIVE TITLE OR INSUFFICIENT EVIDENCE OF OWNERSHIP - Question of ownership deter-mined by court action. SUPPORTING DOCUMENTS SURRENDERED - Yes - Outstanding Certificate of Title. If from out-of-state, out-of-state Titles are surrendered when entering Cherokee Nation. A computer printout is sent to the previous state or tribe. VIN INSPECTION - Inspection by a representative of the Commission required for a motor vehicle previously

registered in any other state or country; prerequisite to titling.

III. PERFECTION OF SECURITY INTEREST The lienholder is responsible for filing a lien. The dealer may perfect a lien on behalf of the lender. Security inter-ests are recorded with the Cherokee Nation Tax Commission. LIEN SHOWN ON CERTIFICATE OF TITLE - Yes. LIEN SHOWN ON DUPLICATE TITLE - Yes. LIEN SHOWN ON REGISTRATION CERTIFICATE - No. ELECTRONIC LIEN AND TITLE (EL T) PROGRAM - Please contact the Cherokee Nation Tax Commission for information. TITLE MAILED TO LIENHOLDER - No - Title mailed to registered owner. LIEN INSTRUMENT - A lien may be filed by the secured party by presenting the Manufacturer's Statement of Origin or Cherokee Nation Title or the out of state Title and the Cherokee Nation Lien Entry Form. The Cherokee Nation Lien Entry Form is a six-part carbon form. All information must be typed on the form; no handwritten forms will be accepted. To secure their interest, the lienholder shall complete an Cherokee Nation Lien Entry Form and submit it Cherokee Nation Tax Commission with either the properly assigned MSO, Cherokee Nation Title, or out of state, or other tribal Title for the lien to be perfected. The fee at that time will be $10.00. Senate Bill 2230 amended Title 47 O.S. Section 1110-A2 pertaining to the perfection of liens on all vehicles, boats, and outboard motors, except for a security interest in motor vehicles held by a dealer for sale or lease. The bill provides that when a vehicle, trailer, boat, outboard motor, travel trailer, or manufactured home is to be titled or registered, and the MSO, Title, or Registration reflects a lien on the face of the document or on the assignment and is presented to an agent of the Cherokee Nation Tax Commission the security is to be filed by the agent. The lien filing fee in this situation would be $12.00. LIEN FEE - The fee is $10.00 if the lien entry form is completed and submitted with paperwork, $12.00 if lien entry form is NOT submitted but a lien is indicated on paperwork and the lien entry form has to be completed by an agent of the Cherokee Nation Tax Commission. BOAT LIENS – The procedure is the same as vehicles.. LIEN RELEASED - Within 7 business days after the satisfaction of a secured interest, the lender must mail copy 4 (or a lien release statement) of the release to the last known address of the debtor and copy 3 (or a lien release statement) to the Cherokee Nation Tax Commission to clear their records. Upon release of the security agreement the owner may obtain a new Certificate of Title omitting reference to security by surrendering the Lien Release and the Title to the Cherokee Nation Tax Commission. Lien release statement must contain all of the following: (1) Name of the Secured Party; (2) Name of the Debtor; (3) Vehicle Identification Number (VIN); (4) Notarized signa-ture of Secured Party representative. All information on the lien statement must be typed. No photocopies or faxed copies are acceptable. SECOND MORTGAGE - Complete standard Cherokee Nation lien entry form and furnish Title. SECOND PARTY ADDED TO TITLE WITH LIENHOLDER - No forms are required to be completed by the lienholder. The Title must be properly assigned reflecting a transfer of ownership from the record owner(s) to the record owner(s) and another party. The lien will carry forward to the new Title. In the case where the owner chooses to add the spouse's name, the Title must be properly assigned to both the husband and wife. The fees for vehicles are an $6.00 title fee, and excise tax fee (unless exempt). The fees for a boat or motor are a $6.00 title fee and excise tax fee (unless exempt).

SECOND PARTY ADDED TO TITLE WITHOUT A LIENHOLDER - Properly assigned Title is required. The title must be properly assigned reflecting a transfer of ownership for the record owner(s) to the record owner(s) and another party. The lein will carry forward to a new title. In the case where the owner chooses to add the spouse’s name, the title must be properly assigned to both the husband and wife. The fees for vehicles, boats, mo-tors, trailers and manufactured homes are a $6.00 title fee and the registration tax fee (unless exempt). LIMITED POWER OF ATTORNEY - Lienholder may use. Must be the original document and be notarized. No specific form is required. In the case where the lienholder is authorizing limited Power of Attorney to release a lien on a specific vehicle, boat and/or outboard motor, the unit identification number must be specifically listed on the Power of Attorney. When the lienholder authorizes Power of Attorney to release the lien(s) for any and all vehi-cles, boats and/or outboard motors reflecting the lienholder's name, the Power of Attorney must specifically list this authority. UNIFORM COMMERCIAL CODE ADOPTED - Yes. LENDING INSTITUTIONS (INCLUDING PRIVATE PARTIES) - Not required to have an assigned lender number to record liens. SECOND LIENHOLDER BUYING CONTRACT FROM FIRST LIENHOLDER - The first lienholder files release and the second lienholder refiles.

IV. TRANSFER OF TITLE OR INTEREST Accomplished by an assignment of Title on reverse side of the Certificate of Title. The transfer fee is $6.00. Each person is required by law to obtain a transfer Title in his name within 30 days after acquiring ownership or posses-sion of a vehicle. Assignment must be signed and sworn to before a Notary Public. PLURAL ownership requires the signature of all owners. "OR" or "AND/OR" requires one signature. "AND" requires all signatures. All signa-tures must be notarized. TRANSFER FROM DECEASED OWNER - Whenever any person dies intestate leaving a surviving spouse, and there is among the assets of the decedent's Estate an automobile owned by the deceased, the automobile shall be and become the sole and exclusive property of said surviving spouse. If the deceased held title to more than one automobile at the time of death of said deceased, the surviving spouse shall have the right to choose one of said automobiles to be his or her exclusive property and the remaining automobiles shall be distributed according to the laws of descent and distribution. ODOMETER READING - Upon transfer of ownership of a motor vehicle the seller shall write in the mileage to the left of the signature on the assignment of the Title. The purchaser shall attest to the odometer reading on the assigned Title also. This reading will be transferred to the next Title issued. DAMAGE DISCLOSURE STATEMENT - A Declaration of Damage or Theft must be completed by the appli-cant on vehicles 10 years old or newer.

V. REGISTRATION - FEES – LICENSING Mopeds, motorcycles, motor vehicles, travel trailers, commercial trailers, salvage vehicles, mobile homes, boats and outboard motors in excess of 10 horsepower are also registered. Snowmobiles are NOT registered. For infor-mation on ATVs please contact the Cherokee Nation Tax Commission. APPLICATION FOR REGISTRATION - Applications are submitted to the Cherokee Nation Tax Commission or Motor Licensing Agency. Hand-written applications are accepted along with those submitted by mail.

OUT-OF-STATE VEHICLE – Same as an in-state vehicle, but needs a VIN inspection. PLANNED NON-OPERATION - Each and every vehicle must be registered every year whether their vehicle is operable or not. If a vehicle is not registered each and every year, a penalty will be assessed. TAXES APPLICABLE TO REGISTRATION - None - (Also See Section I.) FEES FOR REGISTRATION - All vehicles other than commercial trucks, tractors, mobile homes, and buses, are categorized as non-commercial. NON-COMMERCIAL - Dependant upon the registration year of the vehicle YEARS 1-4 ($75.00), YEARS 5-8 ($65.00), YEARS 9-12 ($45.00), YEARS 13-16 ($25.00), YEARS 17-OVER ($10.00). BOATS - Every owner of a vessel or motor possessing a Certificate of Title shall, before using such vessel or mo-tor in this state, make an application for the registration of such vessel or motor with the Commission or with a motor license agent. The application shall contain such information as shall be required by the Cherokee Nation Tax Commission. COMMERCIAL TRUCKS, TRUCK-TRACTORS, SEMI-TRAILERS, MOBILE HOMES, TRAILERS – License fee based on the “combined laden weight” of the vehicle or combination of vehicles. The laden weight is the weight of the truck and the cargo or payload transported thereon, or the weight of the truck or truck tractor plus the weight of any trailers and/or semi-trailers plus the cargo or payload transported thereon. For additional infor-mation please contact the Cherokee Nation Tax Commission. REGISTRATION CERTIFICATE - Form used for registering motor vehicles, mobile homes, and trailers. Same Application for Automobile Registration form is used for registering mobile homes and motorcycles. Must be car-ried in the vehicle. FEE FOR DUPLICATE REGISTRATION - The fee is $1.00. FEES FOR FILING LATE REGISTRATIONS - All registrations expire the LAST day of the month shown on the Registration. The following month is the normal month for renewal and no penalty is due during this grace month. After the grace month, penalty accrues at $0.25 per day. On the first day of the following month, the maxi-mum penalty will apply. FEES REDUCED - No. LICENSE PLATES ISSUED - One MULTI-YEAR LICENSE PLATES ISSUED - Yes - License plates issued, decals are issued to update tags each year. CLASSIC/VINTAGE LICENSE PLATES - NA FEE FOR REPLACEMENT OF LOST OR STOLEN LICENSE PLATES OR DECAL - The fee is $10.00. TEMPORARY PERMITS - NA LICENSE PLATES TRANSFERABLE - No - License plates follow the vehicle unless requested by the owner. REGISTRATION EXPIRATION - All registrations will be issued to expire in the month indicated by the decal on the tag. Mobile homes will be registered to expire December 31st of each year. ENFORCEMENT DATE - After the end of the month following the month of expiration.

VI. GENERAL INFORMATION ELIGIBILITY REQUIREMENTS – Applicant must be a member of the Cherokee Nation. Applicant must re-side within the jurisdictional boundaries of the Cherokee Nation. SOVEREIGN AUTHORITY – In accordance with two United States Supreme Court decisions; Oklahoma Tax Commission vs. Citizen Band Potawatomi Indian Tribe of Oklahoma and Sac & Fox Nation vs. Oklahoma Tax Commission, 508 U.S. 114 (1993), the Cherokee Nation, as a sovereign, federally recognized Indian tribe, has the power and authority to Sell tobacco products to members without application of state taxes and issue motor vehicle license tags to its enrolled citizens living within its territorial boundaries. MAXIMUM LEGAL LIMITATIONS: Same as state of Oklahoma. HEIGHT - 13 feet 6 inches. LENGTH - 40 feet single vehicle. WEIGHT - 20,000 Ibs., single axle; 34,000 Ibs. tandem axle; 73,280 Ibs. overall. WIDTH - 8 feet (96 inches) on state roads, 102 inches on divided 4-lane. STATE FUEL TAXES (PER GALLON) – The Cherokee Nation has a Motor Fuels Compact with the State of Oklahoma. Gasoline - $0.16; Diesel-$0.13. ($0.01 assessment per gallon added to both gasoline and diesel.) VIN ISSUED BY DEPARTMENT - Yes - To homemade trailers and reconstructed motor vehicles. Prefix "CN" used in cases of reconstructed motor vehicles. Home-made trailers use a julian date, agent number, and letter code A,B,C, etc., (letter code is issued consecutively when the tag agent issues more than one VIN on the same day). (Also See Reconstructed Vehicles in Section I.) ACKNOWLEDGMENT OF NOTARY PUBLIC - Notary signature, seal, and date commission expires. Re-quired on Certificate of Title. TITLE FILES - Filed by VIN and title number. Records maintained. LICENSE FILES - Filed by license plate number, decal number, title number and VIN. Records maintained. . INFORMATION FEE - $1.00 current owner, $5.00 title history, $6.00 Certified title history. NON-RESIDENT STUDENTS - NA NEW RESIDENT - Must furnish out-of-state Title and proof of Oklahoma liability insurance. A VIN inspection is required. LEASED VEHICLES - Title issued in the name of the lessor. Registration Certificate issued jointly. EXAMPLE: Henry's Leasing Co. clo John Smith – Lessee FINANCIAL RESPONSIBILITY - Oklahoma has a Financial Responsibility Law of $25,000 / $50,000 P.L. and $25,000 P.D. Proof of insurance must be carried in the vehicle. Proof of insurance is required at the time of initial registration, renewal, and transfer. SAFETY INSPECTION - No. HELMETS REQUIRED - Yes - Less than 18 years of age. SAFETY BELTS REQUIRED - Yes - All drivers and front seat passengers of cars, pickups, vans. and sport util-

ity vehicles. regardless of age, must wear safety belts. CHILD RESTRAINT LAW - Children under six years of age must be protected in a properly installed child pas-senger restraint system regardless of their seating position in the vehicle. Children six through twelve years of age must be protected by use of either a properly installed child passenger restraint system or a safety belt. It should be noted that the NHTSA recommends all children from 40 to 80 lbs. and less than 4'9" tall be properly restrained in a booster seat; lifting them so adult lap/shoulder seat belts are positioned correctly and safely. Children these sizes are often ages four to eight and may not be big enough to appropriately fit in an adult seat belt. LEMON LAW - If a new motor vehicle does not conform to all applicable express warranties, and the consumer reports the nonconformity, directly in writing, during the term of the express warranties or during the period of one year following the date of original delivery, whichever is the earlier date, the manufacturer, its agent, or its author-ized dealer shall make such repairs as are necessary to conform the vehicle. If the nonconformity continues to exist after a reasonable number of repair attempts, the manufacturer shall replace the motor vehicle or accept return and refund the consumer (less a reasonable allowance for use). It shall be presumed that a reasonable number of at-tempts have been undertaken to conform a motor vehicle if the same nonconformity has been subject to repair four or more times but such nonconformity continues to exist or the vehicle is out of service for repair for a cumulative total of forty-five or more calendar days.
