Summary
Proportionality is a general constitutional principle coming from the European police
law.Its been explicitly affirmed in Greek case- law with the 2112 decree of the Supreme
Administrative Court of Greece (Council of the state) in 1984. Although there is a sort
of disagreement about its content, it consists of three principles: which are suitability,
necessity and stricto sensu proportionality. It is applied thoroughly in the law construction
and its a commitment for all the three authorities. It stands both in the area of moral and
of the law rule. However, we can not certainly confirm if the proportionalitys control is
grading because of the fact that there are many options in greek law theory and case-law
about that subject.
