Czech Republic takes up EUPresidencyThe Czech Republic took over thePresidency of the Council of theEuropean Union from 1 January 2009.The main priorities of the Czech Presi-dency can be summed up as the“3 E’s”: Economy, Energy and ExternalRelations. These include Euro-Atlanticrelations and further integration of theWestern Balkans. Sweden will take onthe EU Presidency role for the secondhalf of 2009 starting on 1 July.

Slovakia adopts the euroSlovakia became the 16th member of theeuro club on 1 January 2009 when itofficially adopted the EU’s commoncurrency. Giving the changeover addedmeaning was the fact that it took placeon the 10th anniversary of the birth ofthe euro. Commission President JoséManuel Barroso said: “On this tenthanniversary of the euro, I congratulateSlovakia and warmly welcome allits citizens to the euro area. The eurowill help Slovakia to take part in, andbenefit from, Europe’s collective effortto recover from the current economiccrisis. By joining the euro area, Slovakiahas enhanced its long-term potentialto create growth and jobs and keepinflation under control. But the euro ismore than just money. On this historicNew Year’s Day, Slovakia is a power-ful symbol of economic and politicalprogress and of European integration.”

Catherine Ashton new EU TradeCommissionerCatherine Ashton was appointed Euro-pean Commissioner for External Tradeon 6 October 2008. The appointmentfollowed the departure of Peter Mandel-son to take up the position of Secretaryof State for Business, Enterprise andRegulatory Reform in the UK.

Baroness Ashton of Upholland wasformerly the Leader of the House ofLords. She is an economist and previouslyheld positions as Parliamentary Under-Secretary of State in the Departmentfor Education and Skills, ParliamentaryUnder-Secretary in the Department forConstitutional Affairs, and ParliamentaryUnder-Secretary of State at the Ministryof Justice.

She brings with her significant Europeanexperience, including steering the LisbonTreaty through the UK’s upper chamberand dealing with EU justice and homeaffairs issues in her previous positions.

Erasmus Mundus II adoptedOn 22 October 2008 the EuropeanParliament formally adopted the secondphase of the Erasmus Mundus scholar-ship programme (2009-2013).

The European Union will thus continueto support joint academic programmesin Europe with grants to highly-talentedstudents and professors from thirdcountries. The scope of the programmewill also be extended to the doctorallevel while more financial support willbe given to European students. Sincethe Erasmus Mundus phase I waslaunched in 2004, 178 Thai studentsand 10 scholars have been awardedthe scholarships.

EU immigration and asylumpact signedOn 15 and 16 October 2008 the EuropeanCouncil adopted the “European Pact onImmigration and Asylum” which setsout political objectives and strategicguidelines for the development ofEuropean immigration and asylumpolicies. The pact is aimed at achievinga common approach to immigration-related issues in all EU member states,while opening the way for moreimmigration into the Union by highly-skilled workers. EU leaders will reviewimplementation of the pact once a year.

In the EU, the turmoil prompted strongcollective action to stabilise the financialsector. Coordinating national actioninside a set of clear EU principles,complemented with direct EU action,has proved to be the right approach.

Just a year ago few peoplehad ever heard the term‘sub-prime’. However, it didn’ttake long for the financialturmoil brought on by thesub-prime crisis to be feltaround the globe. Giantsof the financial world havebeen brought to their knees.Inevitably, the crisis is alsohaving an effect on householdsand businesses - economicgrowth has slowed sharplyand unemployment has begunto increase.

EU shows solidarityduring financial crisis

National governments, the EuropeanCentral Bank, the Commission and theEuropean Parliament have all been work-ing closely together to protect savings,maintain a flow of affordable credit forbusinesses and households and put inplace a better governance system forthe future.

Meanwhile, at a meeting of leaders ofthe Group of Twenty (G20) in Washing-ton on November 15 the EU threw itsweight behind measures designed toreform financial markets and build moreeffective global financial institutions aswell as to stimulate the global economyand reject protectionism.

Speaking at the event, President of theEuropean Commission José ManuelBarroso emphasized the role the EU hadto play. “We represent 500 millionpeople in the world’s largest tradingbloc. The euro is the world’s secondreserve and reference currency. The EUhas significant direct regulatory powers.Europe’s actions affect everybody. We

will act responsibly, listen to others andshow global solidarity. I am delightedothers have pledged to do the same.”

“We have already shown unprecedentedEuropean coordination in our programmefor supporting banks. We have takenrapid steps to, for example, raise depositguarantees, bring forward proposalsto reinforce capital requirements andcross border supervision, regulate creditratings agencies and modify accountingstandards. Today there is agreement toa coordinated approach not just inEurope but worldwide. Europe will nowplay a full role between now and ournext summit in transforming principlesinto practical and concerted action.”

What is the EU doing?Amid fears of a global recession, theCommission is pressing for rapid adoptionof measures to help small businesses,which create most new jobs in the EU.

A proposed directive on capital require-ments for financial institutions aims atreining in excessive risk-taking by banksand improving supervision of banks thatoperate in different EU countries.

The Commission is also drawing upproposals for stricter regulation of creditrating agencies. These agencies adviseinvestors on how safe investments are,but they failed to spot some of the risksthat led to the current crisis.

In addition, the Commission is looking atthe issue of executive pay, amid concernthat highly-paid bankers are not heldaccountable for making poor investmentdecisions.

In December 2008 the European Councilapproved the European EconomicRecovery Plan, equivalent to about 1.5 %of the GDP of the EU - a figure amountingto around 200 billion. The plan isessentially a joint framework for theefforts made by Member States and bythe EU to ensure consistency andeffectiveness.

The Commission has also made a com-mitment to drive European coordination,to improve global cooperation andto apply EU law with the maximumflexibility.

Held under the theme of Vision andAction: Towards a Win-Win Solution thesummit brought together Heads ofState and Government of 16 Asian and27 European nations as well as thePresident of the European Commissionand the Secretary-General of theASEAN Secretariat.

A warm welcome was extended to theleaders of Bulgaria, India, Mongolia,Pakistan, Romania, and the ASEANSecretariat who were taking part for thefirst time.

The importance of such a gatheringshouldn’t be underestimated: together,these leaders represent around 50%

of world GDP, approximately 58% ofthe world’s population and 60% ofworld trade.

The summit featured in-depth discussionson important international and regionalissues of common interest.

Speaking at the summit, Chinese PremierWen Jiabao said the meeting was sureto, “bring significant and far-reachinginfluence to Asia-Europe cooperation.”

He added that through frank and in-depth dialogues, the participants hadreached common understanding onissues including the internationaleconomic and financial situation, foodsecurity and disaster relief cooperationas well as sustainable development.

His comments were mirrored by thoseof French President Nicholas Sarkozy,representing the Presidency of theEuropean Union.

President Sarkozy called the summit“another great event” after the Beijing

Olympic Games, and said that it hadoffered an important opportunity tohear voices from Asia and Europe.

“We discussed nearly all of the topicsconcerned by the two continents includ-ing the most difficult issues,” he said.

During the summit, leaders reaffirmedthe strategic importance of ASEM, andrecognized the close ties that bind thetwo continents.

They expressed their deep condolencesand sympathy over natural disasters inAsia over the past year and affirmed theircommitment to continued assistance forthe affected countries. The importanceof efficient and prompt delivery ofhumanitarian aid and expertise in theevent of natural disasters was alsostressed.

ASEM’s commitment to strengtheningmultilateralism and a multilateral inter-national system with the United Nationsat its core based on international lawwas reaffirmed.

Current global and regionalissues were on the table whenEuropean and Asian leadersmet at the seventh Asia-Europe meeting in Beijing inOctober 2008.

With a financial storm wreaking havocacross world markets, ASEM 7 provideda timely opportunity for world leadersto discuss a possible collaborativeresponse.

The current international economic andfinancial situation was high on theagenda with leaders expressing concernover the impact of the spreadinginternational financial crisis on the globaleconomy and in particular, the severechallenges it poses to financial stabilityand economic development of countriesin Asia and Europe.

Leaders were of the view that to resolvethe financial crisis it was imperativeto handle properly the relationshipbetween financial innovation andregulation and to maintain soundmacroeconomic policy. They furthermorerecognized the need to improve thesupervision and regulation of all financialactors, in particular their accountability.

About ASEMFor the past 12 years, the Asia-Europe Meeting (ASEM) has beenthe main multilateral channelfor communication between Asiaand Europe, strengthening inter-action and mutual understandingbetween the two regions throughdialogue.

ASEM brings together 27 EUnations with 16 Asian countries aswell as the European Commissionand the ASEAN Secretariat.Summits of ASEM leaders areheld every two years. A range ofother ASEM events take place atvarious levels and enjoy wideparticipation. Committed to combatingclimate change

Leaders expressed their support forstrengthened international cooperationon climate change.

Speaking at a press conference after thesummit, European Commission PresidentJosé Manuel Barroso said that thefinancial crisis must not become anexcuse for not properly dealing withclimate change. If countries did nottake effective actions to tackle climatechange, there would be larger threats,he warned.

Networking for success

A new lease of life for a major ASEMsuccess story, the Trans-Eurasia Informa-tion Network (TEIN), was announcedduring the Beijing summit.

The TEIN2 network currently connects30 million users in 4,000 research andeducation institutions across 10 Asiancountries with each other and their peersin Europe, via links to the high speedGÉANT2 network. Funded by the EUwith 12 million and an additional 6million from Asian partners, the TEIN3network will run until 2011.

A recent seminar held to mark the 60th

Anniversary of the Universal Declaration ofHuman Rights saw the launch of the EUGuidelines on Human Rights Defenders translatedinto Thai and Pattani-Malay (Yawi). We look at therole and importance of human rights defendersand how the guidelines may help them.

Shiningthe light onhuman rightsdefenders

Held on 13 November, the seminarco-organized by the Delegation of theEuropean Commission, French Presidencyof the EU, the Ministry of Justice andInternational Commission of Juristsbrought together human rights defenders,representatives from Thai governmentagencies and members of the diplomaticcommunity. It provided a forum forpromoting and encouraging respectfor the right to defend human rightsand the physical safety of human rightsdefenders.

Highlights of the discussions includedinsights and recommendations basedon cases of human rights defendersin Thailand as well as their personalexperiences.

Writing in the Nation newspaper, KaviChongkittavorn called the event, “Anexcellent opportunity for the Thaiparticipants to take stock of the overallhuman rights situation and the peoplewho are working hard to defend them.”

The role of a human rights defenderis, by definition, to struggle against theodds of a systematic or widely condonedneglect of the protection of humanrights.

Human rights defenders questionpolitical prejudices while facing legalimpediments and rejection by significantparts of society, sometimes even withintheir own communities and families.

By engaging in this struggle, too oftenthey also place themselves, and eventheir families, at great personal risk.

“We should regard human rightsdefenders as the canary in the coal minethat alerts us of unsolved problems inthe depths of society,” said AmbassadorFriedrich Hamburger of the EuropeanCommission Delegation. “We believethat governments can better identifyand address problems and preventthem from becoming a crisis when theyembrace the contributions of humanrights defenders.”

Meanwhile, Mrs Riina Kionka, PersonalRepresentative for Human Rights of theEuropean Union Secretary-General/HighRepresentative Javier Solana stressedthe importance of human rights defend-ers and why they should be helped:“The EU recognizes human rightsdefenders as key actors who contributeto the effective elimination of humanrights violations. This is why it is of the

utmost importance to ensure theirsafety, protect their rights and supporttheir work. The publication of the EUGuidelines in English, Thai and Pattani-Malay, in a unique booklet, is dedicatedto them, as a bridge between diplomaticmissions and local communities.”

The EU places human rights at theheart of its external relations. Thisabstract dedication is translated intoconcrete action in a number of ways.The EU engages various countries indialogues whilst also actively promotinghuman rights within various interna-tional fora, such as the United Nations.

Another important way in which theEuropean Union draws attention tohuman rights is through guidelinesadopted on specific questions of concernsuch as the death penalty, torture andinternational humanitarian law. The EUGuidelines on Human Rights defenderswas adopted in 2004.

All of these guidelines serve as a frame-work for protecting and promotinghuman rights in third countries. They

The guidelines stress that, althoughthe work of human rights defendersoften involves criticism of government’spolicies and actions, governmentsshould not see this in negative light.

“The principle of allowing room forindependence of mind and free debateon a government’s policies and actionsis fundamental: it is a tried and testedway of establishing a better level ofprotection of human rights and funda-mental freedoms,” said Mrs Kionka.

However, Mrs Kionka recognised thedifficulty in translating words into action.“It is one thing to say it is importantto work with human rights defenders,including NGOs, and to write a Guide-line. It is another thing to put that intopractice,” she said.

The EU therefore undertook an exercise

to assess how the guidelines were being

used in day-to-day work. As a result of

this review, the European Union adopted

a set of sixty-four recommendations to

improve awareness and implementation

of the guidelines.

Some of these suggestions included

translating the guidelines into local

languages; devising local strategies for

the promotion of the Guidelines; inviting

human rights defenders to meetings at

missions; undertaking visits to human

rights defenders in remote regions; and

giving particular attention to the situa-

tion of women human rights defenders.

To follow-up on these recommenda-

tions, the EU asked all Member State

embassies and European Commission

delegations around the globe to formul-

ate strategies on how to translate those

recommendations into action.

“One of the more sensible local

strategies I have seen is the one sent

from Bangkok,” says Mrs Kionka. “It

characterises the situation for defenders

here, and then goes on to set out an

ambitious but realisable strategy for

Thailand. One of the points was to

translate the Guideline into the Thai and

Pattani-Malay languages, and this has

now been done.”

Ambassador Hamburger stressed that

the translation of the Guidelines should

not be seen as the EU suggesting what

the Thai government should do.

“The Guidelines should be seen as

an instrument used by the EU to imple-

ment the UN Declaration on human

rights defenders and, as such, they only

are binding within the EU. For other

countries they could and should serve

as an example on how to strengthen

the respect, protection and promotion

of human rights in their own political

and social environment. And if in

developing its own guidelines Thailand

sees that parts of our document can

be useful when adapted to the Thai

reality, we will have been successful

in our objective of supporting and

promoting human rights at home and

abroad,” he said.

What do the EU Guidelines on HumanRights Defenders include?The Guidelines identify ways for EU missions to supportand assist human rights defenders working in third(non-EU) countries in five different areas.

“Monitoring, reporting and assessment” This explainshow EU diplomatic missions should monitor, assess andreport back to the EU on the situation of human rightsdefenders in their country of residence.

“Role of EU missions in supporting and protectinghuman rights defenders” This explains which kind ofconcrete actions EU diplomatic missions can take. Theseinclude receiving human rights defenders in the missionsor visiting their area of work, to give visible recognitionto human rights defenders as well as attending andobserving trials of human rights defenders.

“Promotion of respect for human rights defendersin relations with third countries and in multilateralfora” This contains a list of concrete steps to take, such

as for EU actors to meet with human rights defenderswhen they pay visits to third countries or raise individualcases with the host government.

“Support for Special Procedures of the UN HumanRights Council, including the Special Representativeon Human Rights Defenders” This includes that the EUwill encourage states to accept as a matter of principlerequest for country visits by UN special procedures andgive financial support to the Office of the High Commis-sioner for Human Rights.

“Practical support for human rights defenders”This includes support for the establishment and work ofnational bodies for the promotion and protection ofhuman rights such as national human rights institutions,ombudsman’s offices and human rights commissions.

“Thailand is a key country that can

promote human rights within the

framework of ASEAN and can act as an

engine to help make the forthcoming

human rights body of ASEAN more

effective,” he said.

The EU hopes that the development of

local strategies for the protection of

human rights defenders will mark a

further step towards ensuring that human

rights defenders can conduct their

invaluable work without intimidation.

And by translating the guidelines into

Thai and Yawi it is hoped that awareness

of what a human rights defender is,

and some of the support mechanisms

available to them, will be raised.

“Many people who are human rights

defenders do not realize that they

are,”Mr Cautain said. “We hope that by

making the Guidelines understandable

and accessible, people will realize that

they are part of a larger framework and

they are not alone.”

Why were new rules needed?The rules applicable before 1 September2008 were complex. For some pesticides,the European Commission would setMaximum Residue Limits (MRLs),for others, EU Member States wereresponsible. For some pesticides, theCommission could set MRLs, but theMember States could fix higher MRLs.And for some pesticides, no MRLswere set at all.

For traders and importers, having to dealwith 27 lists of national MRLs led toconfusion about which MRL they hadto respect. For consumers, the confusionled to concerns about the safety ofpesticide residues in particular in caseswhere food exceeding the MRL in oneMember State would be acceptable inother Member States.

What is in the new regulation?The new Regulation covers all agriculturalproducts intended for food or animalfeed. MRLs for 315 fresh productsare listed, but these MRLs also apply tothe same products after processing,adjusted to take account of dilution orconcentration during the process.

The Regulation covers pesticides currentlyor formerly used in agriculture in or out-side the EU (around 1,100). Where apesticide is not specifically mentioned, ageneral default MRL of 0.01 mg/kg applies.

What are MRLs?The amounts of residues found in foodmust be safe for consumers and mustbe as low as possible. A maximumresidue level (MRL) is the highest levelof a pesticide residue that is legallytolerated in or on food or feed. The EUMRLs for all crops and all pesticides canbe found in the MRL database on theEuropean Commission website.

With a userfriendly search tool MRLs can be viewedby crop, by crop group, by crop code orby pesticide in all EU languages. The European Union & Thailand À¿“æ¬ÿ‚√ª & ª√–‡∑»‰∑¬

The Regulation covers the safety ofall consumer groups, including, forexample, babies, children and vegetarians.The safety assessment for consumers isundertaken by the European Food SafetyAuthority (EFSA), based on the toxicityof the pesticide, the maximum levelsexpected on food and the different dietsof European consumers.

The Regulation clearly designates therole of the Member States, EFSA and theCommission in the setting of MRLs andcontains: the EU MRLs (about 45,000)already in force before September 2008;the recently harmonised MRLs previouslyset by the Member States (about 100,000);and a list of low risk substances forwhich MRLs are not necessary.

EU simplifies rules onpesticide residues

Consumers are unknowingly exposed to different types ofpesticides as residues can be found on harvested crops. FromSeptember 2008 onwards a new EU Regulation came into forcewhich lays down revised rules for pesticide residues.

The EU explained √Ÿâ®—° À¿“æ¬ÿ‚√ª

In crisis zones across the world around100 international and about 250 nationalstaff of ECHO assess humanitarian needsand monitor the implementation ofprogrammes by partner organizationssuch as the United Nations, the Red Crossand International NGOs. In Southeast Asia, ECHO has had a pre-sence in Thailand since 1997. In June2004, a Regional Support Office in Bangkokwas set up to cover crises in East andSoutheast Asia as well as the Pacific witha team ready to respond at a moment’snotice when disaster strikes.

Currently humanitarian aid operationsfunded by the European Commission areunderway in Burma/Myanmar, Thailand,Indonesia, Timor Leste, Cambodia, LaoPDR, the Philippines and Vietnam.

In Thailand, ECHO provides significantassistance to over 140,000 displacedpeople living in camps on the Thai-Burmese border.
