Justice minister does partial backtrack on court charges

Fees to be reduced or abolished in some cases such as eviction from family home

Justice Minister Alberto Ruiz-Gallardón told lawmakers in Congress that he plans to partially modify controversial court filing charges that his department recently introduced.

The fees for basic legal measures such as divorce petitions have raised the hackles of members of the judiciary system itself, who have argued it restricts access to justice to the well-off.

Gallardón said his department is drawing

up a decree that will make changes to the law introducing the charges and will anticipate aspects of a free justice law he is also preparing.

The decision to backtrack came in response to a report by the Ombudsman, Soledad Becerril, highlighting anomalies in the legislation. Gallardón insists the charging system is needed to prevent courts being bogged down by needless lawsuits and appeals, but acknowledges charges should be reduced in some cases and eliminated in others such as cases involving evictions from the family home.

Russian mafia at Costa Brava bribed mayor of Lloret de Mar Andrey Borisovich Petrov did everything that the mayor of Lloret de Mar told him to, and more. According to the High Court judge investigating the case, Petrov — the alleged boss of a Russian mafia operating out of the Costa Brava — sponsored the local soccer and hockey teams between 2007 and 2010, and paid in cash for a luxury trip to Russia for then-mayor Xavier Crespo, his wife and one of their children. Once there, Crespo and his family enjoyed helicopter rides, expensive meals and free shows. In exchange, Crespo pardoned 133,000 euros in municipal taxes that Petrov should have paid for his building activities, and changed local ordinances to allow the mob chief to erect a shopping center inside the old bullring, where a sports complex had originally been planned. Investigators also suspect that part of the club sponsorship money may have gone into

the pockets of Crespo and his aides.

High Court Judge Eloy Velasco is asking the regional High Court of Catalonia to indict Crespo on charges of bribery and corruption. Because he is a regional deputy, he enjoys a

degree of parliamentary immunity and can only be tried by a High Court. Crespo’s deputy mayor, Josep Valls, has already been indicted in connection with the case.

During the February 2008 trip to Russia, Petrov introduced Crespo to Viktor Kanaikin and Sergei Nalinov, “the real owners” of Diagnostics Development Company (DDC) – the front that the mafia boss allegedly used to launder money in Lloret de Mar. Kanaikin and Nalinov were also “leaders” of the international money laundering scheme, according to Judge Velasco’s report.

Catalonia hosted 14.45 million foreign tourists in 2012, a 10% increase compared to 2011Catalonia receives 25% of all the foreigners visiting Spain, being by far the most popular destination. 14,447,814 foreign visitors travelled to Catalonia in 2012, a 9.9% increase compared to the 2011 figures, according to a survey on Frontier Tourist Movements (Frontur), released on Tuesday by the Spanish Ministry of Industry, Energy and Tourism. Catalonia’s figure is particularly relevant compared to the Spanish average: 57,700,714 million foreign tourists visited Spain last year, a 2.7% growth compared to the previous year. The largest market sending tourists to Catalonia continues to be France. Other European countries such as the United Kingdom and Germany are increasing their share, as well as relatively new markets such as Russia and China.

The Autonomous Community receiving the second largest number of foreigners is the Balearic Islands, with 10.44 million, a 3.3% increase compared to 2011. It is followed by the Canary Islands with

10.14 million (-0.7%), Andalusia with 7.59 (-2.3%), the Valencian Country (also called Valencian Community) with 5.35 million (+0.2%) and the Community of Madrid with 4.49 million (+0.4%).

Regarding the data for December, the number of foreign tourists visiting Catalonia only that month was 622,258, a 7% increase compared to data from December 2011. Besides, 2,638,306 foreigners visited Spain in the last month of the year. Therefore, Catalonia attracted 23.6% of those international tourists, while the Canary Islands attracted 35%.

PP does U-turn on eviction initiative in Congress

The ruling Popular Party bowed to intense pressure and agreed to back a popular legislative initiative in Congress organized by the Mortgage Victims Platform (PAH) to address a spate of foreclosures and evictions, PP congressional spokesman, Alfonso Alonso.

The previous day, the ruling party said its response to the initiatives, which came in the wake of a number of cases of suicide involving people facing imminent eviction, would be a “polite no.”

An elderly couple in Calviâ on the island of Mallorca were found dead in their home on Tuesday by their son, who discovered a suicide note saying they had taken their own lives after receiving a notice to leave their property.

The PP has an absolute majority in the lower house ensuring approval of the consideration measures, which received the backing of the other groups in Congress.

The initiative was debated in the lower house. During the debate, speaker Jesús Posada ordered the visitor galleries to be emptied after members of the public jeered the PP.

The PAH gathered 1.5 million signatures supporting the initiative, which calls for a backdated halt to evictions, the enactment of a dation in payment law that will allow those who have had their homes foreclosed to cancel the mortgage by handing the property over to the bank, and the creation of a pool of social housing for those who lose their homes.

PAH members met with PP lawmakers prior to the vote in an effort to convince them to change their minds. “Today, we will see if parliament is blind and deaf in the eyes of the people,” said PAH activist Martín Batllorí. PAH spokeswoman Ada Colau added: “We are asking deputies not to show disrespect to the people.”

NewsSantander probed by UK agency for misleading advice to customers Banco Santander said Wednesday it was being investigated by the UK Financial Services Authority (FSA) over investment advice its staff gave to researchers posing as retail customers in so-called mystery shopper tests, Bloomberg reported.

UK banks gave inadequate advice to a quarter of customers in its review last year, the FSA said in a report released Wednesday. The agency did not name the banks that were probed. However, Bloomberg said the FSA had referred Santander to its enforcement division for further investigation, and told other banks to improve how they deal with customers.

Santander will “review how it can offer advice to its customers in the future for their benefit and provide access to appropriate investment products,” Bloomberg quoted the bank as saying in a statement.

The regulator sent people who didn’t identify themselves as representing the FSA to invest money at six UK banks. Employees gave them unsuitable advice 11 percent of the time, the agency said in a statement. Advisers didn’t gather enough information about the clients in 15 percent of visits.

“This review shows that customers are not consistently getting the quality of advice on their investments that they should expect when visiting an adviser in a bank or building society,” said Clive Adamson, FSA director of supervision.

Spanish President wants to curtail foreign activity of Catalan governmentThe Spanish government is preparing a law to control international trips, initiatives, and agreements undertaken by the “autonomous” communities

In Catalonia’s process toward self-determination, one of the areas in which the Catalan government has begun to put more attention is internationalization. Precisely because of its importance, the Spanish government has proposed stopping the Catalan government’s foreign actions, and to that end is preparing a “Law of Foreign Action and Service”. The bill will be presented in the Council of Ministers today for its approval and foresees, among other things, that the Ministry guide and approve the international relations of the autonomous communities.

The autonomous communities could act in other countries but they will have to inform the Spanish government about all of the trips, visits, and initiatives that they wish to undertake. The Ministry will decide if such actions are approved and that will depend on whether or not they are in accordance with the objectives stipulated by the Spanish government. “Unity of movement and coordinated institutional loyalty” will be the principles invoked by the new law.

The Spanish government can’t prohibit the president of an autonomous community from making an offical trip, but they can approve it or not. And the Spanish embassies will also disregard such trips.

In addition, the new law also foresees that the Spanish government control any agreements that an autonomous

government sign with foreign organizations in order to verify that these do not violate or overstep their jurisdiction and aren’t unconstitutional. They will also be refrained from participating in foreign affairs or in international treaties.

Any proposals to create foreign offices will also be subject to prior approval by the Spanish government. Any “recommendation” made on any of these principles will be considered binding in those autonomous communities that have not fulfilled their budget stability objective. Just last week the Catalan government announced that its 2012 budget deficit was 2.3%, 8 tenths over the objective set by the Spanish government.

Scottish multinational requests permission to look for gas and petrol on Costa Brava coast

A Scottish multinational has asked the Spanish Ministry of Industry for an authorisation to look for hydrocarbons on the northern Catalan coast. Capricorn Spain S.L., the Spanish subsidiary of Scottish Cairn Energy, wants to carry out soundings in more than one million hectares out to sea, from the Gulf of Lion, close to Perpignan in France, stretching down to the Greater Barcelona area, passing by in front of the Costa Brava and Maresme.

Ecologist groups criticise the procedure due to their “serious impact on the marine ecosystems”. Allegations or other offers to carry out the project that can compete with the original one, may be presented over the next two months.

The multinational asked for permission more than a year ago, and now the Minister of Industry has started to respond to the petition by publishing it in the Official Bulletin of the State (BOE), the official gazette of the Government of Spain. Allegations or other offers to carry out the project that can compete with the original one, may be presented over the next two months.

If the project goes ahead Catalonia will not be the only place in the Mediterranean Sea where Cairn Energy will try to look for fuel; it already has permission to look for hydrocarbons on the Valencian coast.

This request takes place shortly after a similar petition from another company, Teredo Oils United, which has been authorised to seek for fossil fuels in the Catalan counties of Ripollès, Garrotxa and Osona (in northern Central Catalonia).

Ecologists object

Fossil fuels research will be done using seismic analysis. This technique allows rocky formations which can contain petrol and gas to be found. Ecologist groups have criticised this method, and both the Naturalists Association of Girona and the Ninam Project claim that these explorations will “have a serious impact on marine ecosystems”.

The two ecologist groups declare that seismic analysis will damage fish, cephalopods, cetaceans and coral. Besides, both groups claim that the area of exploration is “huge”, and that it will affect both “high ecological value spots” and “migratory animals”. They also say that some protected cetaceans groups live in this part of the Mediterranean.

Ecological groups say that they will present allegations to the project of Capricorn Spain Limited S.L., and add that, if necessary, they will ask for the “support of citizens to present legal procedures to stop the company”.

Catalonia, leader in organ transplants despite donor reductionCatalonia registered 228 donors, 209 of which had died an encephalic-related death and the 19 remaining due to a heart attack, a type of donation that has increased by 18.7% in relation to 2011. The main cause of the donor’s death is still a vascular cerebral accident in 61% of cases. The average age of the body donor is 57.5 years old, a figure which confirms the tendency that the age of the donor is rising.

Waiting lists for organ transplants were generally reduced by 4.6% in comparison to 2011. The waiting time for lung or pancreas surgery has been the most reduced, followed by liver and kidney operations. However, the waiting lists for a heart or gut transplant have not suffered any variation.

Catalonia leads the number of living donors for kidney transplants, with 147 cases in 2012, 4.3% higher than 2011 and is responsible for at least half of this kind of transplants in Spain. In total, 559 kidney transplants -17 of them pediatric- have been carried out in the same period of time.

Lung transplants have increased by 35% with 64 operations on adults and 2 on children. With respect to liver transplants, 171 operations were on adults and 9 on children while 52 were the total number of heart transplants and 15 surgeries of pancreas transplant. On the other hand, 484 bore narrow transplants were carried out and 68 of them pediatric.

Van botontkalking merkt men
