Subject: Chartering of Tanker for KODAP

A. General Information

Cyprus Organisation for Storage and Management of Oil Stocks (KODAP) is inviting offers for the

chartering of a tanker to perform a voyage as per KODAP’s requirements below.

B. Requirements

Offers are invited for the chartering of a tanker in order to fulfil the following voyage:

Loading Port Larnaka SPM

Discharge Port VTT Vasiliko Jetty

Loading Laycan 4 - 10 June 2015

Grade AGO LS 10ppm

Quantity 40,000 m3

Charter Party ASBATANKVOY with KODAP’s Amendments as shown

on Appendix A

Laytime Loading rate 450-600m3/hr from Larnaca

Address commission To be included in lumpsum freight

Tenderers must submit the following:

1. Completed Form Of Tender as shown on Appendix B

2. Vessel’s latest Q88 certificate

An Agreement using ASBATANKVOY and KODAP’s Amendments shown in Appendix A will be

enforced after award by KODAP and shall be deemed duly signed.

C. Procedure

You are kindly requested to submit your offer on or before Friday 22 May 2015, 12.00 hours local

time via email at [email protected]. The offer must remain valid until Monday the 25 May

2015, 18.00 hrs, by which KODAP will decide whether to accept or decline your offer. You will

be notified of the outcome of your tender submission the latter date by email.

APPENDIX A

KODAP AMMENDEMENTS ON ASBATANKVOY:

1. GENERAL CLAUSES

1.1 PRIVACY AND CONFIDENTIALITY CLAUSE

THIS CHARTER PARTY IS TO BE KEPT STRICTLY PRIVATE AND CONFIDENTIAL. THIS

CHARTER PARTY AND OR ANY PART OF IT WILL NOT BE DISCLOSED TO ANY THIRD

PARTY WITHOUT CONSENT OF BOTH PARTIES SIGNED HEREIN.

1.2 WEATHER CLAUSE

DELAYS IN BERTHING FOR LOADING OR DISCHARGING AND ANY DELAYS AFTER

BERTHING WHICH ARE DUE TO WEATHER CONDITIONS SHALL COUNT AS ONE HALF

LAYTIME OR, IF ON DEMURRAGE, AT ONE HALF DEMURRAGE RATE.

1.3 AGENTS CLAUSE

OWNERS TO APPOINT AGENTS NOMINATED BY CHARTERERS AT ALL PORTS.

1.4 NOTICE CLAUSE

CHARTERERS SHALL BE ALLOWED THE BENEFIT OF THE SIX (6)HOURS NOTICE TIME

OR TIME UNTIL ALL FAST, THE EARLIEST BETWEEN THE TWO, AT EACH PORT OF

LOADING AND DISCHARGING, EVEN IF VESSEL ON DEMURRAGE.

1.5 NOTICE OF READINESS CLAUSE

VESSEL NOT TO TENDER NOTICE OF READINESS AT LOADING PORT PRIOR

COMMENCEMENT OF LAYDAYS UNLESS OTHERWISE INSTRUCTED BY CHARTERERS,

IN WHICH CASE TIME TO COMMENCE TO COUNT FROM COMMENCEMENT OF

LOADING.

1.6 EARLY LOADING CLAUSE

IF CHARTERERS ALLOW VESSEL TO LOAD PRIOR LAYDAYS, IT IS AGREED THAT TIME

SAVED BETWEEN BERTHING AND COMMENCEMENT OF LAYDAYS WILL COUNT AS

ADDITIONAL LAYTIME, AND WILL BE DEDUCTED FROM DEMURRAGE, IF ANY.

1.7 BALLAST CLAUSE

THE VESSEL SHALL ARRIVE AT FIRST LOADING PORT WITH CLEAN BALLAST.

ALTERNATIVELY, WHERE SHORE FACILITIES FOR RECEIVING DIRTY BALLAST ARE

AVAILABLE, ANY COST, EXPENSES FOR DISCHARGING, RECEIVING AND STORING

BALLAST ASHORE SHALL BE FOR OWNER'S ACCOUNT.

THE TIME FOR THIS OPERATION WILL NOT COUNT AS USED LAYTIME, OR IF THE

VESSEL IS ON DEMURRAGE, AS DEMURRAGE, UNLESS CONCURRENT WITH LOADING.

1.8 INERT GAS SYSTEM CLAUSE (APPLICABLE ONLY TO VESSELS FITTED WITH

IGS)

OWNERS SHOULD WARRANT THAT THE VESSEL HAS A WORKING INERT GAS

SYSTEM AND OFFICERS AND CREW ARE EXPERIENCED IN THE OPERATION OF THE

SYSTEM.

OWNER FURTHER WARRANT THAT THE VESSEL WILL ARRIVE AT LOAD PORT WITH

CARGO TANKS FULLY INERTED, BUT DEPRESSURIZED, ALLOWING VISUAL

INSPECTION OF VESSELS TANKS FROM DECK. THE TANKS WILL REMAIN INERTED

THROUGHOUT THE VOYAGE AND DURING DISCHARGE.

IN THE EVENT MASTER IS REQUIRED BY TERMINAL PERSONNEL OR INDEPENDENT

INSPECTOR(S) TO BREACH THE INERT GAS SYSTEM FOR THE PURPOSE OF GAUGING,

SAMPLING, TEMPERATURE DETERMINATION OR ESTABLISHING THE QUANTITY OF

CARGO REMAINING ON BOARD AFTER DISCHARGE, MASTER SHALL COMPLY WITH

THESE REQUESTS CONSISTENT WITH SAFE OPERATION OF THE VESSEL AND

REGULATIONS OF THE PORT/TERMINAL.

ANY TIME LOST RESULTING FROM NON COMPLIANCE WITH THIS CLAUSE SHALL

NOT COUNT AS USED LAYTIME, OR AS DEMURRAGE IF THE VESSEL IS ON

DEMURRAGE.

1.9 PUMPING CLAUSE

OWNERS SHOULD WARRANT THAT VESSEL IS CAPABLE OF DISCHARGING HER FULL

CARGO WITHIN 24 HOURS OR MAINTAIN 100 PSI AT THE MANIFOLD DURING

DISCHARGING, PROVIDED SHORE FACILITIES PERMIT. IF SHORE FACILITIES DO NOT

PERMIT SUCH DISCHARGING RATE, MASTER TO FILE LETTER OF PROTEST SIGNED BY

MASTER AND TERMINAL REPRESENTATIVE AND ATTACH SAME TO DEMURAGE

CLAIM. ANY REASON HINDERING TO MAINTAIN LOADING OR DISCHARGING SPEED

SHOULD BE REPORTED BY MASTER TO CHARTERERS IMMEDIATELY.

ANY ADDITIONAL TIME USED OWING TO THE INABILITY OF THE VESSEL TO

DISCHARGE THE CARGO WITHIN 24 HOURS, OR TO MAINTAIN AN AVERAGE

DISCHARGE PRESSURE OF 100 PSI AT THE VESSELS MANIFOLD THROUGHOUT THE

DISCHARGE, SHALL BE FOR OWNERS ACCOUNT AND SHALL NOT COUNT AS

LAYTIME OR, IF THE VESSEL IS ON DEMURRAGE, AS DEMURRAGE.

ANY CLAIM BY OWNERS FOR ADDITIONAL TIME USED IN THE FOREGOING

CIRCUMSTANCES WILL BE FOLLOWED BY THE BELOW DOCUMENTATION:

A. PUMPING LOG, SIGNED BY A RESPONSIBLE OFFICER OF THE VESSEL AND A

TERMINAL OR CHARTERERS RERESENTATIVE, SHOWING THE PRESSURE

MAINTAINED AT THE MANIFOLD THROUGHOUT THE DISCHARGE.

B. COPIES OF ALL NOTES OF PROTEST ISSUED OR RECEIVED BY THE VESSEL IN

RELATION TO THE DISCHARGE IN QUESTION.

1.10 CARGO RELEASE WITHOUT PRESENTING ORIGINAL BILLS OF LADING

CLAUSE

SHOULD ONE OF THE ORIGINAL BILLS OF LADING NOT BE AVAILABLE AT

DISCHARGE PORT(S), VESSEL SHALL DELIVER CARGO AGAINST CHARTERER'S L.O.I.,

IN ACCORDANCE WITH P&I CLUB WORDING. CHARTERER WILL NOT BE ASKED TO

PROVIDE BANK GUARANTEES.

OWNER SHOULD ADVISE THE WORDING FOR THE L.O.I. LATEST TWO WORKING DAYS

PRIOR TO VESSEL'S ARRIVAL AT THE FIRST DISCHARGING PORT.

THIS CLAUSE IS APPLICABLE ALSO FOR CHANGE OF DESTINATION.

1.11 WAITING FOR CARGO DOCUMENTS CLAUSE

MAXIMUM THREE HOURS WAITING FOR CARGO DOCUMENTS TO BE FOR

OWNERS'ACCOUNT AT EACH PORTS OF CALL.

1.12 CARGO RETENTION CLAUSE

IN THE EVENT THAT ANY CARGO REMAINS ON BOARD UPON COMPLETION OF

DISCHARGE, CHARTERER SHALL HAVE THE RIGHT TO DEDUCT FROM FREIGHT AN

AMOUNT EQUAL TO THE FOB VALUE AT LOADING PORT OF SUCH CARGO PLUS

FREIGHT DUE WITH RESPECT THERETO, PROVIDED THAT THE VOLUME OF CARGO

REMAINING ON BOARD IS NOT PUMPABLE AND REACHABLE BY VESSEL'S FIXED

EQUIPMENT AS DETERMITED BY AN INDEPENDENT SURVEYOR. ANY ACTION OR

LACK OF ACTION IN ACCORDANCE WITH THIS PROVISION SHALL BE WITHOUT

PREJUDICE TO ANY RIGHTS OR OBLIGATIONS OF THE PARTIES.

1.13 TIME BAR CLAUSE

CHARTERERS SHALL BE DISCHARGED AND RELEASED FROM ALL LIABILITY IN

RESPECT OF CLAIMS OWNERS MAY HAVE FOR DEADFREIGHT AND DEMURRAGE,

UNLESS A CLAIM HAS BEEN PRESENTED TO CHARTERERS WITHIN NINETY (90) DAYS

FROM COMPLETION OF DISCHARGING AND 120 DAYS FOR SHIFTING A/O PORT

EXPENSES. HOWEVER IF A LOAD OR DISCHARGE OPERATION, IN A PORT EXCEEDS

THE 36 HOURS OWNERS MUST PUT CHARTERERS ON NOTICE AND TO SEND

RELEVANT DOCUMENTS BY FAX UPON COMPLETION OF SUCH OPERATION.

1.14 NIGHT NAVIGATION CLAUSE

IN SOME PORTS THERE ARE BERTHING/UNBERTHING RESTRICTIONS DURING NIGHT

HOURS. OWNERS HAVE TO CONSULT WITH LOCAL AGENTS, AND BE AWARE OF

THESE RESTRICTIONS. TIME LOST DUE TO PROHIBITION OF NIGHT NAVIGATION

WILL NOT COUNT AS LAYTIME, AND IF THE VESSEL IS ON DEMURRAGE, AS

DEMURRAGE.

1.15 DIVERSION CLAUSE

CHARTERERS HAVE THE RIGHT TO CHANGE THE LOADING AND/OR DISCHARGING

PORTS OR ITS ROTATION, ALWAYS WITHIN THE RANGE STATED IN THE MAIN TERMS

OF THE CHARTER PARTY. ANY EXTRA TIME AND EXPENSES INCURRED BY THE

VESSEL TO COMPLY WITH SUCH CHANGE(S) OF ORDERS SHALL BE FOR

CHARTERERS' ACCOUNT AND CALCULATED IN ACCORDANCE WITH MAIN TERMS OF

THIS CHARTER PARTY. FREIGHT IS BASED ON THE VOYAGE ACTUALLY PERFORMED.

CHARTERERS HAVE THE RIGHT TO MAKE AS MANY CHANGES AS THEY DEEM

NECESSARY.

IF CHARTERERS NEED THAT THE VESSEL INTERRUPTS HER VOYAGE AT ANY TIME

BEFORE OR AFTER LOADING, SUCH TIME TO COUNT AS LAYTIME OR DEMURRAGE IF

ON DEMURRAGE.

1.16 IN TRANSIT LOSS CLAUSE

IN ADDITION TO ANY OTHER RIGHTS WHICH CHARTERERS MAY HAVE, OWNERS

WILL BE RESPONSIBLE FOR THE FULL AMOUNT OF ANY IN-TRANSIT LOSS IF IN-

TRANSIT LOSS EXCEEDS 0.25% BY VOLUME AND CHARTERERS SHALL HAVE THE

RIGHT TO DEDUCT FROM FREIGHT AN AMOUNT EQUAL TO THE FOB LOADING PORT

VALUE OF SUCH CARGO PLUS FREIGHT AND INSURANCE DUE WITH RESPECT

THERETO. IN-TRANSIT LOSS IS DEFINED AS THE DIFFERENCE BETWEEN NET VESSEL

STANDARD VOLUMES AFTER LOADING AT THE LOADING PORT AND BEFORE

UNLOADING AT THE DISCHARGE PORT. VOLUME OF CARGO TO BE ASCERTAINED AT

LOADING PORT AND DISCHARGE PORT BY INDEPENDENT INSPECTORS APPOINTED

BY CHARTERERS WHOSE FINDINGS ARE TO BE FINAL AND BINDING ON BOTH

PARTIES.

1.17 VOYAGE ORDERS CLAUSE

OWNERS SHALL BE RESPONSIBLE FOR ANY LOSS OR DAMAGE FOR NOT ADHEREING

TO CHARTERERS VOYAGE ORDERS. IF FOR ANY REASON THE OWNERS FEEL THEY

CANNOT COMPLY WITH THE CHARTERERS VOYAGE ORDERS THEY SHALL

IMMEDIATELY CONTACT THE CHARTERERS FOR INSTRUCTION.

1.18 BIMCO ISPS CLAUSE (BIMCO) ISPS Clause for Voyage Charter Parties (AMENDED)

(A) (I) FROM THE DATE OF COMING INTO FORCE OF THE INTERNATIONAL CODE

FOR THE SECURITY OF SHIPS AND OF PORT FACILITIES AND THE RELEVANT

AMENDMENTS TO CHAPTER XI OF SOLAS (ISPS CODE) IN RELATION TO THE VESSEL,

THE OWNERS SHALL PROCURE THAT BOTH THE VESSEL AND "THE COMPANY" (AS

DEFINED BY THE ISPS CODE) SHALL COMPLY WITH THE REQUIREMENTS OF THE

ISPS CODE RELATING TO THE VESSEL AND THE COMPANY. UPON REQUEST THE

OWNERS SHALL PROVIDE A COPY OF THE RELEVANT INTERNATIONAL SHIP

SECURITY CERTIFICATE (OR THE INTERIM INTERNATIONAL SHIP SECURITY

CERTIFICATE) TO THE CHARTERERS. THE OWNERS SHALL PROVIDE THE

CHARTERERS WITH THE FULL STYLE CONTACT DETAILS OF THE COMPANY

SECURITY OFFICER (CSO).

(II) EXCEPT AS OTHERWISE PROVIDED IN THIS CHARTER PARTY, LOSS,

DAMAGE, EXPENSE OR DELAY, EXCLUDING CONSEQUENTIAL LOSS, CAUSED BY

FAILURE ON THE PART OF THE OWNERS OR THE COMPANY TO COMPLY WITH THE

REQUIREMENTS OF THE ISPS CODE OR THIS CLAUSE SHALL BE FOR THE OWNERS

ACCOUNT.

(B) (I) THE CHARTERERS SHALL PROVIDE THE CSO AND THE SHIP SECURITY

OFFICER (SSO)/MASTER WITH THEIR FULL STYLE CONTACT DETAILS AND ANY

OTHER INFORMATION THE OWNERS REQUIRE TO COMPLY WITH THE ISPS CODE.

(II) EXCEPT AS OTHERWISE PROVIDED IN THIS CHARTER PARTY, LOSS,

DAMAGE, EXPENSE, EXCLUDING CONSEQUENTIAL LOSS, CAUSED BY FAILURE ON

THE PART OF THE CHARTERERS TO COMPLY WITH THIS CLAUSE SHALL BE FOR THE

CHARTERERS ACCOUNT AND ANY DELAY CAUSED BY SUCH FAILURE SHALL BE

COMPENSATED AT THE DEMURRAGE RATE.

(C) PROVIDED THAT THE DELAY IS NOT CAUSED BY THE OWNERS FAILURE TO

COMPLY WITH THEIR OBLIGATIONS UNDER THE ISPS CODE, THE FOLLOWING

SHALL APPLY:

(I) NOTWITHSTANDING ANYTHING TO THE CONTRARY PROVIDED IN THIS

CHARTER PARTY, THE VESSEL SHALL BE ENTITLED TO TENDER NOTICE OF

READINESS EVEN IF NOT CLEARED DUE TO APPLICABLE SECURITY REGULATIONS

OR MEASURES IMPOSED BY PORT FACILITY OR ANY RELEVANT AUTHORITY

UNDER THE ISPS CODE.

(II) ANY DELAY RESULTING FROM MEASURES IMPOSED BY PORT FACILITY

OR BY ANY RELEVANT AUTHORITY UNDER THE ISPS CODE SHALL COUNT AS

LAYTIME OR TIME ON DEMURRAGE IF THE VESSEL IS ON LAYTIME OR

DEMURRAGE. IF THE DELAY OCCURS BEFORE LAYTIME HAS STARTED OR AFTER

LAYTIME OR TIME ON DEMURRAGE HAS CEASED TO COUNT, IT SHALL BE

COMPENSATED BY THE CHARTERERS AT THE DEMURRAGE RATE.

(D) NOT WITHSTANDING ANYTHING TO THE CONTRARY PROVIDED IN THIS

CHARTER PARTY, ANY ADDITIONAL COSTS OR EXPENSES WHATSOEVER SOLELY

ARISING OUT OF OR RELATED TO SECURITY REGULATIONS OR MEASURES

REQUIRED BY THE PORT FACILITY OR ANY RELEVANT AUTHORITY IN

ACCORDANCE WITH THE ISPS CODE INCLUDING, BUT NOT LIMITED TO, SECURITY

GUARDS, LAUNCH SERVICES, TUG ESCORTS, PORT SECURITY FEES OR TAXES AND

INSPECTIONS, SHALL BE FOR THE CHARTERERS ACCOUNT, UNLESS SUCH COSTS OR

EXPENSES RESULT SOLELY FROM THE OWNERS NEGLIGENCE. ALL MEASURES

REQUIRED BY THE OWNERS TO COMPLY WITH THE SHIP SECURITY PLAN SHALL BE

FOR THE OWNERS ACCOUNT.

(E) IF EITHER PARTY MAKES ANY PAYMENT WHICH IS FOR THE OTHER PARTYS

ACCOUNT ACCORDING TO THIS CLAUSE, THE OTHER PARTY SHALL INDEMNIFY

THE PAYING PARTY.

1.19 FORCE MAJEUR CLAUSE

ANY DELAY(S) ARISING OUT OF OR RESULTING FROM ADVERSE WEATHER OR SEA

STATE CONDITIONS, FIRE, EXPLOSION, BREAKDOWN OR FAILURE OF EQUIPMENT,

PLANT OR MACHINERY IN OR ABOUT PORTS OR PLACES OF LOADING AND/OR

DISCHARGE, ACT OF GOD, ACT OF WAR, LABOUR DISPUTE, STRIKE, RIOT, CIVIL

COMMOTION, OR ARREST OR RESTRAINT OF PRINCES, RULERS OR PEOPLES SHALL,

PROVIDED ALWAYS THAT SUCH CAUSE WAS NOT WITHIN THE REASONABLE

CONTROL OF CHARTERERS OR OWNERS OR THEIR RESPECTIVE SERVANTS OR

AGENT, COUNT AS ON HALF LAYTIME OR, IF THE VESSEL IS ON DEMURRAGE, AT

ONE HALF OF THE DEMURRAGE RATE.

SHOULD THE CIRCUMSTANCES REFERRED TO IN THE PREVIOUS PARAGRAPH

CONTINUE WITHOUT INTERRUPTION FOR MORE THAN 30 DAYS WITHOUT ANY

REASONABLE PERSPECTIVE OF CHANGE, BOTH PARTIES WILL HAVE THE OPTION TO

VALIDLY DECLARE THIS C/P FUSTRATED AND BOTH PARTIES SHALL BE EXCUSED OF

ANY FURTHER PERFORMANCE, WITHOUT PREJUDICE OF THE RIGHTS AND REMEDIES

THAT ANY PARTY COULD HAVE IN RESPECT OF THE SUMS ACCRUED BEFORE

FRUSTRATION. THE PARTY INTENDING TO EXERCISE THE OPTION CONTAINED IN

1.20 INTERIM VOYAGE CLAUSE

FROM POSITION GIVEN WHEN FIXING, VESSEL WILL NOT PERFORM ANY INTERIM

VOYAGE. VESSELS SCHEDULE TO BE PROVIDED ACCORDINGLY.

2. CERTIFICATION CLAUSES

2.1 SHIPS CERTIFICATES CLAUSE

OWNERS SHOULD WARRANT AND GUARANTEE THAT THE PERFORMING VESSEL HAS

THE REQUIRED CERTIFICATES, ALL BEING IN FULL FORCE THROUGHT THE

INTENDED VOYAGE AND IN FULL VALIDITY INCLUDING THOSE CERTIFICATES

REQUIRED UNDER LAST EDITION OF SOLAS, MARPOL AND THE COUNTRY OF

REGISTRY, TO PERFORM THE INTENDED VOYAGE AND TO LOAD, CARRY AND

DELIVER THE INTENDED CARGO.

2.2 P. & I. AND POLLUTION COVER CLAUSE

OWNERS SHOULD WARRANT THAT THEY ARE AND WILL REMAIN THROUGHOUT THE

CHARTER PARTY AS FOLLOWS:

A. MEMBERS OF INTERNATIONAL TANKER OWNERS' POLLUTION FEDERATION LTD

(I.T.O.P.F.)

B. THE VESSEL SHALL BE PROPERLY INSURED WITH A RETUBLE CLUB WITHIN THE

INTERNATIONAL GROUP OF P&I CLUBS AND SHALL CARRY ON BOARD A VALID

CERTIFICATE IN ACCORDANCE WITH:

(i) THE 1992 INTERNATIONAL CONVENTION ON CIVIL LIABILITY FOR OIL

POLLUTION DAMAGE (CLC 92); AND

(ii) THE 2001INTERNATIONAL CONVENTION ON CIVIL LIABILITY FOR BUNKER

OIL POLUTION DAMAGE (2001 BUNKERS CONVENTION)

C. THE VESSEL SHALL BE PROPERLY INSURED IN ACCORDANCE WITH THE 1976

CONVENTION ON LIMITATION OF LIABILITY FOR MARITIME CLAIMS AS

AMENDED (LLMC 1996) AND SHALL CARRY ON BOARD A CERTIFICATE OF ENTRY

ISSUED BY A REPUTABLE CLUB WITHIN THE INTERNATIONAL GROUP OF P&I

CLUBS OR PROOF OF OTHER FINANCIAL SECURITY.

D. THE VESSEL SHALL MAINTAIN INSURANCE COVER FOR OIL POLLUTION DAMAGE

OF 1.000.000.000 (ONE BILLION) USD THROUGH A PEPUTABLE P&I CLUB WITHIN

THE INTERNATIONAL GROUP OF P&I CLUBS.

2.3 I.T.F. CLAUSE

OWNERS SHOULD WARRANT THAT VESSEL/CREW WILL REMAIN IN COMPLIANCE

WITH THE REQUIREMENTS OF I.T.F., OR OTHER EQUIVALENT ORGANIZATION,

DURING THIS CHARTER PARTY. ANY DELAY AND/OR EXPENSE RESULTING FROM

NON-COMPLIANCE WITH THIS WARRANTY SHALL BE FOR OWNERS' ACCOUNT AND

TIME NOT TO COUNT AS LAYTIME OR IF ON DEMURRAGE, AS DEMURRAGE.

2.4 Q88 CLAUSE

OWNERS SHOULD WARRANT AND GUARANTEE THAT THE PERFORMING VESSEL IS IN

COMPLIANCE WITH ALL ITEMS STATED IN VESSEL’S Q88. ANY DELAY AND/OR

EXPENSE RESULTING FROM NON-COMPLIANCE WITH THIS WARRANTY SHALL BE

FOR OWNERS' ACCOUNT AND TIME NOT TO COUNT AS LAYTIME OR IF ON

DEMURRAGE, AS DEMURRAGE.

3. CLEANING CLAUSE

OWNERS SHOULD WARRANT THAT VESSEL'S LINES, TANKS AND PUMPS SHALL BE IN

ALL RESPECT SUITABLE TO CHARTERERS' INSPECTOR'S SATISFACTION FOR

LOADING CHARTERERS' CARGO AND PARTICULARLY THAT HER TANKS, PUMPS, AND

LINES SHALL BE CLEANED AND DRIED, ENTIRELY WITHOUT ANY WATER AND/OR

RESIDUES, NOR ANY TRACE OF MOISTURE, WITHOUT ANY SMELL. IF SHIP IS FOUND

UNSUITABLY CLEAN, SHE WILL BE CLEANED UNTIL APPROVAL IS OBTAINED FROM

CHARTERERS' INSPECTOR. TANK SHOULD BE GASFREED AND CERTIFIED AS SAFE

FOR THE INSPECTION OF THE INSPECTOR.

ANY DELAYS AND COSTS AS A RESULT OF VESSEL ARRIVING AT LOADING PORT

AND NOT BEING TO CHARTERERS' INSPECTOR'S SATISFACTION SHALL BE FOR

OWNERS' ACCOUNT, INCLUDING ALL COSTS FOR SUBSEQUENT INSPECTIONS.

IF FURTHER CLEANING IS NECESSARY, AND IF 24 HOURS AFTER FIRST INSPECTION

BY CHARTERERS' INSPECTOR, WHOSE DECISION WILL BE FINAL, OR AFTER THE

CANCELLING DATE, WHICHEVER IS THE LATEST, THE VESSEL IS STILL UNSUITABLE,

CHARTERERS SHALL HAVE THE OPTION TO CANCEL THE CHARTER.

PARTY CANCELLATION OR FAILURE TO CANCEL SHALL BE WITHOUT PREJUDICE TO

ANY CLAIMS FOR DAMAGES CHARTERERS MAY HAVE AGAINST THE OWNER.
